1. These terms
These Terms of Service (“Terms”) are an agreement between you and CollectorCredits (“CollectorCredits,” “we,” “us”), the operator of the website at collectorcredits.com and its related services (the “Site”). By creating an account, signing in, or using the Site you accept these Terms and our Privacy Policy. If you do not agree, do not use the Site.
We may change these Terms. We will change the date at the top and, for material changes, post a notice on the Site or email you. Using the Site after a change takes effect means you accept the changed Terms. If you do not, close your account.
2. Who can use CollectorCredits
- You must be at least 18 years old, or at least 13 with a parent or legal guardian who has read these Terms, accepts them on your behalf, and supervises your use. The Site is not for children under 13.
- Trading requires a shipping address in the United States or Canada.
- One account per person. You may not create accounts for others, share an account, or create additional accounts to obtain signup credits, bonuses or referrals more than once.
- We may refuse, limit or close an account at our discretion, including where we cannot verify who you are or where the law does not allow you to trade.
3. Your account
- You sign in with a code sent to your email address, or with Google. There is no password. The email account you use is your key: keep it secure, and tell us at once if you believe someone else has used your CollectorCredits account. You are responsible for everything done through it until you do.
- Your collector name is public and must not impersonate anyone, infringe anyone’s rights, or be offensive. We may change or reclaim a name at our discretion. Names you have used stay reserved to your account.
- Your account is personal and may not be sold, transferred or lent.
- Keep your shipping address current. Cards mailed to the address on file when a seller accepted your offer are treated as delivered to you.
4. Collector Credits are not money
Collector Credits (“CC” or “credits”) are a closed-loop trading balance that exists only inside the Site. The reference “100 CC ≈ $1” is a guide to card values expressed in credits and nothing more.
- Credits have no cash value. They are not money, currency, a deposit, a security, a gift card, or a stored-value instrument. They earn no interest.
- Credits cannot be redeemed, refunded, withdrawn, or exchanged for money or anything of value outside the Site, and cannot be sold, transferred or assigned to anyone except through a trade on the Site.
- Credits we grant — including the 500 CC signup grant and any bonus, referral or promotional credits — are given at our discretion. We may change, limit, condition or end any grant or bonus program at any time, and may reverse credits granted in error or obtained through a violation of these Terms.
- We may correct balances to fix errors, reverse credits from cancelled or fraudulent trades, and place holds on credits that are committed to an accepted trade.
- Credits in an account that is closed by you or by us have no value and are not paid out (section 11). We may also expire credits in accounts that have been inactive for more than 24 months, after emailing the address on file.
- We may change how credits are earned, spent, valued or displayed. Where a change would reduce an existing balance we will give notice first.
5. Earning credits from offers
The Site may offer ways to earn credits without trading, through an offer wall operated by a third party. Using it is optional and forms no part of any trade.
- The offers are not ours. Each one is provided by an advertiser through the offer wall operator. Your dealings with them — signing up, installing software, answering a survey, buying anything — are between you and them, on their terms. We do not control, endorse or guarantee any offer, and we are not responsible for what an advertiser does, charges, sends you, or fails to deliver.
- Whether an offer completed is their determination, not ours. We credit what the offer wall reports to us. If an offer does not report, reports late, or reports a different amount than you expected, our role is limited to passing on what we receive and, where we can, asking them to look again. We do not promise that any offer will credit.
- What you earn is at our discretion. We set and may change the share of our revenue that is paid out as credits, the amount any offer is worth, and which offers are available, and we may suspend or end the program at any time without notice. Credits are not earned until they appear in your balance.
- We may hold an earning for review before crediting it, and may decline to credit one we believe is invalid, duplicated, or obtained in breach of these Terms or the offer wall’s own rules.
- Earnings are reversible. An advertiser may reverse a completion after it has credited, sometimes weeks later. We will deduct the reversed amount from your balance. If your balance is lower than the amount reversed, your balance may go below zero, and credits you earn or receive afterwards will go towards clearing it before you can spend them. We will not undo a completed trade to recover a reversal: cards you already received are yours, and credits already paid to a seller stay paid.
- Manipulating the offer wall is a breach. Completing offers through more than one account, misrepresenting who you are, using automation, emulators, VPNs or falsified device or location information, or any other attempt to obtain credits you did not genuinely earn, may cost you the credits involved and your account (section 11).
- Our determination is final. Where we decide whether an earning is valid, whether to credit, hold, decline or reverse one, or whether an account has abused the program, that decision is final.
What the offer wall and its advertisers collect about you, and the one identifier we pass to them, are described in our Privacy Policy.
6. Trading
We are a platform, not a party
Every trade is between two collectors. CollectorCredits matches standing wants to available cards, holds the buyer’s credits while a send is in progress, moves them on delivery, and provides Trade Protection and dispute tools. We do not own, hold, inspect, grade, authenticate, pack, or ship any card, and we are not a party to any trade. Other collectors are not our employees or agents.
Listing cards
- List only cards you own and can ship. Every card must be genuine: no counterfeits, proxies, reprints presented as originals, or cards altered to look like a different printing or condition.
- Describe each card accurately: the exact printing and finish, the condition under our condition guide, and for graded cards the grading company, grade and certificate number as they appear on the slab.
- Making a card available is an offer to trade it on the terms of any matching want. Accepting a match is a binding commitment to ship that card, in the condition described, to the buyer’s address on file.
Wants
A want is a standing offer to pay the stated credits for a matching card. Only wants your balance can fund, including the 125 CC postage charge, can match. When a seller accepts a match, the credits for that card (and, for the first card in a package, the postage) are held from your balance until the send settles or is cancelled.
Sending
- Postage is paid by the buyer as a flat 125 CC per package, however many cards it holds, and is reimbursed to the seller at settlement. The seller chooses and pays for the actual postage and packaging.
- A seller must seal and mail a send promptly, in packaging that protects the cards (sleeves and rigid protection at a minimum), and enter the carrier and any tracking number. A send that is not sealed within 14 days, or sealed but not mailed within 7 days, may be cancelled automatically and the buyer’s credits released.
- The sender bears the risk of loss or damage until the package is delivered. We strongly recommend tracked shipping and photographs of each card and the addressed, stamped package before it is mailed; those photographs are your evidence.
Receiving and settlement
- A buyer must confirm delivery honestly and promptly, no earlier than 48 hours after the send was marked shipped. If a buyer has not confirmed 21 days after shipping, the send settles automatically in the seller’s favour.
- Settlement moves the held credits to the seller (less the Trade Protection fee), pays the postage reimbursement, and records the cards as the buyer’s. Settlement is final except through a Trade Protection claim.
- Either party may cancel a trade before the package is mailed, subject to the rules shown on the Site. Cancelling accepted trades repeatedly, or failing to ship, may lead to suspension.
Prices and values
The market prices shown on the Site are references drawn from third-party sources, may be delayed, incomplete or wrong, and change without notice. They are not appraisals, not offers by us, and not a promise of what any card will trade for. You are responsible for the offers you set and accept.
7. Trade Protection and fees
- The fee. When a trade settles, 3% of what the seller is paid — on each card and on the postage reimbursement — is retained by CollectorCredits. There are no other fees to join, catalog, list or set wants. We may change the fee with notice on the Site.
- The program. The fee funds Trade Protection, which may reimburse a collector, in credits, when cards never arrive or arrive in a condition materially worse than described. Reimbursement is paid only in Collector Credits, only up to the credits paid for the affected cards and postage, and never in money.
- Claims. A claim must be made through the process published on the Site, within the time it states, and with the evidence it asks for (tracking, photographs, the private condition report). We decide claims in our sole discretion on the evidence available, and our decision is final. We may deny, reduce or reverse a claim where the evidence is insufficient, where the claimant contributed to the loss, or where we suspect abuse, and we may suspend collectors on either side of an abusive claim.
- What it is not. Trade Protection is a discretionary program we run for the community. It is not insurance, not a guarantee, not a warranty of any collector’s conduct, and not a contract to pay any particular claim. We may change, limit or end it at any time.
8. Feedback and other content
- You keep whatever rights you have in the feedback, names, descriptions and other content you submit. You give us a worldwide, royalty-free licence to store, display, reproduce and use it to run and promote the Site for as long as the Site exists, including after your account closes where it is part of the trade record.
- Feedback must be honest, about a real trade, and free of personal information, threats or abuse. Sellers may leave buyers positive feedback only. The private condition report a buyer leaves is never shown to the seller.
- We may edit, hide or remove any content at our discretion, and we are not obliged to.
9. What you may not do
- Trade counterfeit, altered or misrepresented cards, or deliberately misgrade condition.
- Create multiple accounts, or use another person’s account, to obtain signup credits, bonuses or referrals, or to trade with yourself.
- Set wants or list cards you do not intend to honour, or manipulate matches, prices, feedback or reputation.
- Accept a match and fail to ship, confirm delivery of cards you did not receive, or refuse to confirm cards you did.
- Harass, threaten, deceive or impersonate anyone, or contact another collector outside the Site to complete a trade around our fees or protections.
- Use bots, scrapers or automated tools on the Site, probe or interfere with its security, or copy our catalog, prices or other data for another service.
- Use the Site for anything illegal, or in a way that breaks these Terms.
If you see any of this, tell us at [email protected].
10. Intellectual property
The Site — its code, design, text, the CollectorCredits name and the CC coin mark — belongs to CollectorCredits and its licensors. You may use it only to trade as these Terms allow. Pokémon, the card names, artwork and related marks belong to Nintendo, Creatures, The Pokémon Company and their licensors; the Site uses card names and images for identification only and is not affiliated with, sponsored by or endorsed by any of them.
If you believe content on the Site infringes a right you hold, write to [email protected] with the content’s location, the right infringed, your contact details and a statement that you believe the use is unauthorised. We will act on valid notices promptly, including by removing the content.
11. Suspension and closure
- We may suspend, limit or close your account, cancel pending sends, hold or reverse credits, and remove content at any time, with or without notice, if we believe you have broken these Terms, if we suspect fraud or a risk to other collectors, if the law requires it, or for any other reason at our discretion. Credits obtained through a violation are forfeited.
- You may close your account at any time by writing to us. Trades you have accepted must still be completed, and credits remaining when an account closes, by you or by us, have no value and are not paid out.
- Sections 4, 6, 7, 9 and 11 through 15 survive closure.
12. No warranties
THE SITE, THE MATCHING, TRADE PROTECTION, THE PRICE REFERENCES, THE CATALOG AND EVERYTHING ELSE WE PROVIDE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE; THAT ANY WANT WILL MATCH; THAT ANY CARD IS GENUINE, AS DESCRIBED OR WILL ARRIVE; THAT ANY PRICE OR VALUE SHOWN IS ACCURATE; OR THAT ANY OTHER COLLECTOR WILL PERFORM. YOU TRADE WITH OTHER COLLECTORS AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, COLLECTORCREDITS AND THE PEOPLE WHO OPERATE IT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF CARDS, CREDITS, PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO THE SITE, ANY TRADE, ANY OTHER COLLECTOR’S CONDUCT, OR THESE TERMS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF WE WERE ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE FEES YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR ONE HUNDRED US DOLLARS ($100). A TRADE PROTECTION REIMBURSEMENT, WHERE ONE IS GRANTED, IS YOUR SOLE REMEDY FOR A TRADE THAT GOES WRONG. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
14. Indemnification
You will defend, indemnify and hold harmless CollectorCredits and the people who operate it from any claim, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of or related to your use of the Site, the cards you list or ship, the trades you take part in, the content you submit, your violation of these Terms, or your violation of any law or any right of another person.
15. Disputes, arbitration and governing law
Talk to us first. If you have a dispute with us, write to [email protected] and we will try to resolve it informally within 30 days.
Arbitration. If we cannot, any dispute, claim or controversy arising out of or relating to the Site or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either of us may bring an individual claim in small claims court, and either of us may seek an injunction to protect intellectual property. The Federal Arbitration Act governs this section. You and we each waive the right to a jury trial and to take part in a class action, class arbitration or representative proceeding. If the class-action waiver is found unenforceable for a particular claim, that claim proceeds in court, not in arbitration.
Opting out. You may opt out of arbitration by emailing us within 30 days of first accepting these Terms, stating that you opt out; the rest of these Terms still apply.
Governing law. These Terms are governed by the laws of the United States and of the state in which CollectorCredits is operated, without regard to conflict-of-law rules, and any court proceeding these Terms allow will be brought in the courts of that state.
Time limit. Any claim against us must be brought within one year after it arises, or it is barred.
16. General
- These Terms and the Privacy Policy are the whole agreement between you and us about the Site and replace any earlier understanding.
- If any part of these Terms is found unenforceable, the rest stands.
- Our not enforcing a term is not a waiver of it.
- You may not assign these Terms. We may assign them, for example to a new operator of the Site.
- We are not liable for delays or failures caused by events beyond our reasonable control, including postal service disruption.
- We may give notices by email to the address on your account or by posting on the Site.
